  • H1B Approved - L1B Extension Denied

    Dear Immi Experts,

    I need your kind suggestions on the following as I need to travel accordingly.

    On 11/15 my L1B extension was denied, while my I94 was expired on 09/15/2011.
    On 11/16 my fresh H1B was approved, my employer said that they have applied it as fresh H1B effective 10/01.

    Here are my questions.
    1.I think I will be out of status since my extension is denied and I94 was expired, as I got the H1B approval with start date as 10/01 shall I switch to H1B and continue here?
    2. Since I94 expired and I am out of status,do I need to quit US and come back on H1B with fresh I94 after going through stamping process?

    You can check your H1B petition notice. If there is no change of status filed for you (which might be the case as your L1 was already expired) then you need to go out of the country to get your new H1B stamped and come back with a valid status.
    In your petition notice - it must be saying something like consulate processing is required.

      Check if your H1 approval notice has a new I-94 at the bottom or not.

        Thanks to both of you.

        Although the online status shows that "On Nov 16, this I129 Petition was approved and we sent you an e-mail notice" my employer didnt receive any email until now, so fingers crossed!

        In case if it have I94 at the bottom is it legal to continue in US on H1B starting from next Monday, as my I94 was expired already and L1B extension was denied a day before the H1B approval?

          Dear Experts,

          I got my H1B approval as Consular Processing, so I am back to India and waiting for the documents from my employer. But, my employer mentioned that I have to attend stamping at Chennai though I am staying in Hyderabad.

          Now my current company is asking me to travel to UK on some other project, so I have to travel ASAP or I have to quit the company.
          1. Please let me know if I can attend the stamping at London Consulate(USA) Office?
          2. I returned back to India as soon as I got to know the L1B Extension was denied, will it be a problem at the time of stamping?
