Hello - Have a question around the L1 Visa. Will try explaining this with the help of an example for the ease of understanding.
Mr. X is looking to move to Company A from its subsidiary in India to the US in the next couple of months. All criteria around work, etc are met. The possible visa currently seems like L1 (considering H1 for the year is closed). Company A has been acquired by Company B and the official transition is sometime in Q2 of 2012. Company B does not have a subsidiary in india and it is expected that Mr. X will be transferred to Company B from Company A.
My questions are -
Would it be possible for Mr. X to work on the same L1 Visa for Company B after the acquisition comes through in Q2 of 2012? If not, what would be the best Visa to move to the US on?
If it has to be a H1B then, is there a work around possible which would allow Mr. X to transfer to the US for Company A on L1 and then work for Company B while they file for a fresh H1?
If nothing of the above holds good, then what would be the best solution from your perspective?
