  • VISA Expired. Surviving with I94s.

    Hi Friends,

    I am stuck with a problem here. Currently myself and my family have valid I94s till Jul 2013 even though our VISAs were already expired last month. But next year my wife and my daughter are going to India for a 3 month vacation for my wife's brother's marriage. Once my wife and my daughter step out of US they are supposed to drop their I94s. And you know that all of our VISAs are already expired.

    That being said, if my wife and daughter appears for the VISA stamping in US consulate (India) next year to get their brand new L2 VISAs stamped to return back to US they will require a copy of my passport. But my VISA is already expired and currently I am in US on the basis on I94 date. So my question here is, will my family able to get new L2 visas based on my current I94 or they require a valid L1 visa of mine.

    ya..u need valid L1 visa to process L2 visa of your dependents.

      There is no such requirement. They can apply for their L2 Visas based on your employer's approved petition and your I-94.
