I-94 Issue Need help

Hi,

Me and my husband's visa expired on Oct 5th 2011. My husband has valid I-94 till Feb-2014 so his company did not apply for his L1 extension. I applied for my L2 extension based on his I-94.
When he applied for his DL extension, we came to know his I-94 status was not updated in their system and when we called they said now they cannot do anything with I-94 since L1 extension petition was not received.
How to proceed now? Since he had valid I-94, we did not apply for extension and now they are saying its not updated in their system.

Who did you call? USCIS?
What did the DMV tell you? They have processes to check with DHS when an I-94 does not show up in their system. Speak with a supervisor at the DMV and tell them to get confirmation from DHS or USCIS. You have nothing to speak with USCIS because you don't have any application pending with them.
One more thing you can try is visit the nearby CBP deferrred inspection post at an international airport (search CBP.gov for locations). I assume this I-94 was given at the POE. Ask them that this I-94 is not showing up in DMV systems and they may be able to update.
