My first L1-b Visa got approved on August 2008 and I traveled around August 2009 to USA and worked there for 2 years. My visa got expired on May 2011 where I applied for an extension which got rejected which lead to my travel back to India. As H1 quota got already full and considering my immediate travel back to onsite my employer is again processing a new L1B visa where I my PAI date possibly would fall around January 2012. Is this a good approach to immediately file under the same visa Category which was denied before? Also is there a difference between extension getting rejected and primary visa application getting rejected? Appreciate your help. Thanks in advance.
