L2 EAD to H1B

I am on L1 Visa and my husband is having L2 - EAD and he is currently working with US company as full time.

Can he apply for H1B? If yes and his petition got approved then his EAD becomes invalid or not?

Since the H1B cap is currently over he cannot,unless he had a H1B earlier and uses that to file a cap exempt H1B. And yes, if the H1B comes through as a change of status he loses the L2 status and consequently EAD
