    Hi ...

    My petition and visa is valid till Apr'2012 . At port of entry my i94 was given till Dec'2014 (this is my second visit on same L1B visa & petition and stayed 2 years earlier) .

    As i94 was given for another 3 years at port of entry would it mean that petition is automatically extended till i94 end date ??

    Most probably since your petition is blanket, its expiry does not matter.

      The petition may have no end date but since your Visa is expiring in April 2012, if you travel back to your parent company country (from where L1B was initially stamped) then the I-94 will be taken at the Airport when traveling back and you will have to go for stamping again at the Consulate. In a nutshell, if you travel out of US after April 2012 you will have to go for stamping again, if you dont intend to travel you can legally stay till Dec 2014. This is my opinion, please do seek expert help to confirm.

          Thanks for the responses.

          As per the details in i-129S , the validity is mentioned till Apr'2012 only which is same as the visa expiry date. Any thoughts?

            I didn't get your question. As I said earlier, if you travel out of US after April 2012, your I-94 will be taken at the airport and you will have to go for stamping again, if you dont intend to travel you can legally stay till Dec 2014. Please do seek expert and legal opinion too.
