    Hi,

    I am a software engineer with 6 years of total experience and 1.3 years of experience in current company . I lead a team of 5 members. I can show some unique skills also. My company is processing L1 A blanket visa for me. I am first level manager. Please anyone suggest me which type visa would suit me better. L1A individual or L1B Individual or L1A blanket or L1B blanket

    Hello,

    6 Years seems to be on the lesser side for processing L1A. L1A is designed for transferring Managerial/Executive staff within Company's subsidiaries from foreign country to US. You would have to demonstrate managerial and executive decision making which may involve the ability to hire/fire people in home country as well as US, to judge performance of the team, to take on financial decisions which can impact the company's financials etc. Further, L1B is for specialized skill sets in Company;s proprietary processes,tools, technology, products etc so again it becomes difficult to prove one has specialization with only 1.3 Years in the Organization. L1 Individual would be the best fit but then again that depends on how long you have worked with the current client you are going to work for. L1s have been heavily scrutinized off late and you would need to work closely with your employer and attorney to determine if that is the route to be taken for you. This is my opinion please do seek expert opinion.

      Thanks a lot for the reply . I have been working with the same client for 1.3 years. I have an experience of 3 years in a product developed by my current organization. I am hired to my current company because of these skill sets.

        Well, as I said earlier, the VO would have to get convinced that you are the unique person with this skill set. They can always question as to why only you from the company who needs to go? Did you develop or help in developing this product? How many people from your company know about this product? How many people in US know about this product? What differentiates you from them? I don't want to discourage you in anyway but that's the way things have been off late with the consulates. I would suggest you discuss with your employer and their immigration team to prepare a strong case.
