  • A year to end my visa

    Hello,

I have a L1B visa which was obtained by the company of my country, and that visa expires in 2013 but they won´t renew because the U.S company for those who have developed work, want sign with me.

    My questions are:
    - Can I travel for US and work by the end of the year, without renew the visa ?
    - Can the US company try get me the renew of this visa?

    Thank you.

I could not understand much of your question. L1 Visas are for transferring employees of a company from an overseas location to within US. So if Company A has processed your L1, lets say from India, then you can only work for a subsidiary/group/parent company of A in US on this L1. Typically Company A HR in India will transfer you tot company A HR of US. Now company A can in turn have a client company B for which you can work but the payroll would still have to be generated by company A US office. Technically if the Company A US office has work then you can surely travel and work for them without involving Company A India branch . This my opinion, please do seek expert legal and immigration opinion too.

The company I work with (Company A) has a subsidiary in the United States and provides workers to other companies (company B). One company wants to hire me. As my L1 was obtained by (company A) and was not made the request for extension of duration of the visa, then is the final year of validity, ending in 2013.

Can I continue to use the L1 visa that I still have to work directly for the company of the U.S. without the intervention of company A taking advantage of the last year of visa? Making the payroll directly for the U.S. Company?

      Thank you.

Sorry, I have said one thing wrong. My L1A visa is aggregate to the subsidiary of the company A. So the subsidiary is located in the US.

Earlier you said you have L1B now you said you have L1A. I am confused. Not that it matters much in this regard, but legally you cannot work for company B, for working with company B you would have to come on H1 from company B. I repeat again, L1 is company specific and one cannot use L1 of company A to work for company B. The whole purpose of L1 is defeated if ones payroll is processed by a company different from the one who have processed L1. This is my opinion please do seek expert opinion too.

Sorry for my mistake, after some search I have check the documents and I saw that the visa is L1A.

ok, with your last answer I no longer have doubts about the purpose of L1 visa.

Thanks to your answers, I have did search about how to get around this problem and I have read about the hypothesis about cancel the visa. Know something about it?

Once again, thanks for your answers, has been very helpful.
