L1 Clarification

Hi

I worked in India under company X and moved to US in L1 B to company Y (Both are sister concerns). My payroll was thru X. So Y is like a client for me. I came back for extension and it got denied. But now company Y wants to do my visa. Is new L1 is possible under company Y ??. I was with company Y for 3.5 years.

What else is possible if L1 is not to get me there soon. Please let me know.

It may be possible if X and Y are subsidiaries or similar. I am sure Y will hire experienced lawyers to handle this.

will it be a new L1 by Y or how it will be. As I mentioned my extension thru the company X was denied by consulate Once.??

L1 Clarification

If I understand you correctly, Company X has Indian Subsidiary, say XA, and it has a US subsidiary XB. XA filed for your L1 for your transfer from XA to XB. Through XB you worked for Y. Payroll was being done by XB. Right? Now the extension was filed by XA-XB and it was denied. Does Y have a subsidiary in India say YA? If yes, what is the relation between XA and YA? Generally denial applies to all the subsidiaries of X in US (check your I797, whether it has Y mentioned in it) . If X and Y are not related, then Y, if having an office in India, YA can file for a fresh L1 but for that you should have worked with YA for at least one year in last three years in India. Or else Y can file for your H1 and you can start working from Oct 2012. This is my opinion, do seek help from you company lawyer and experts too.
