Drivers License Renewal in Georgia (GA) with pending L1 Extension case

My visa & I-94 are expiring this Jan-2012 end. My Gerogia Drivers License is also expiring at the same time (Jan-2012 end).

I have already filed L1 Visa extension case with USCIS and got RFE , so case is in progress.

Has anyone renewed Drivers License in GA when I-94 has expired but L1 visa extension case is in progress. I know this is the most common scenario with Visa extension.

I have read on posts that in NJ,CA DMV considers the "I-797 (Notice of Action)" letter from USCIS and grants the renewal of Drivers License eventhough I-94 has expired.

I went to GA DMV at "8610 Roswell Rd, Suite 710 , Sandy Springs GA. 30350" but they said they need updated I-94. But when i talked in details they said they will check with their manager (and asked me to come after few days).

Any suggestion on how to get my Drivers license renewed in GA in this situation ?

Don't know about GA, but NJ will indeed accept a Notice of Action *if said notice is for approval of extension* - not for RFE or reception of the extension.

And as the Approval Notice will come with a new I-94 attached - the point about an expired I-94 becomes moot.

I went to 2 DMVs at Georgia but both denied. They said that they need new I-94 (with new date). They cannot work based out of I-797 (Notice of Action)...

Any suggestion on how to get this done....

Does New Jersy or NC DMV accepts I-797 (notice of action) letter ?

We are in the same predicament at the moment. Two different DMV's have sent us away.

Did you ever manage to find a solution and get a temporary extention?

Yes, GA driving License can be renewed on I-797 C receipt.

Initially when I contacted DMV, I was told that approved extension is mandatory to renew the license.
I had applied for I-94 extension for my L1 visa and waiting for approval. And on phone, DMV cc asked me to wait to till approval.
But when I personally visited the DMV office of Marietta, my license was renewed for another 4 months.
As I didn't have valid I94, renewal was for only 4 months and they will renew it again once I94 is approved.
(If rejected, anyway license will not get renewed and you will not need either !)
fees for renewal based on I-797 is $ 50.

Hope this post would help lot of people in such situations.
