  • L2 Visa Query

    Hi ,

I am in US currently on my L1 Visa .
The Visa\I-94 is valid till 10 Jun 2012 and thereafter I am planning to apply for visa extension .
I am getting married on 1 May 2012 and thereafter I will be applying for L2 visa for my spouse .

    My question is -
    1) How many days it takes normally for processing the L2 visa starting with day1 doc submission to visa stamping . Also can I apply for L2 visa with my L1 visa valid for 1 month .
    2) If suppose I get L2 visa by 20 May and then I travel with my spouse to US(JFK\Newark airport) then can I enter US with 15-20 days of my L1 visa validity and then apply for visa extension for both of us from here .
    3) Also do you see any other issues\concerns with this plan .

    Thanks .
    SK

If you prepare all the documents, book a Visa interview date and get your marriage certificate immediately, Visas are normally issued within 1 or 2 days after the interview. Visa interview date can be booked before the wedding (date has to be after the wedding, having marriage certificate in hand).

Your I-94 will depend on whether your petition is blanket or individual. 3 years of I-94 is given by default (or 2 years for second trip) if the petition is blanket.
In case I-94 expiry is according Visa expiry (mostly in case of L1 individual), your employer will have to file your extension and that must reach USCIS before your I-94 expires.

      Thanks for the answer .

Regarding my second question , When I travel to India , I will have to submit the I-94 form in US .
In india I will only have L1B visa in my passport .
Since my L1B visa will expire on 10 June and if I enter US on 25 May with spouse then at port of entry a new I-94 should be issued . My question was can I enter in US with visa validity of only 15 days remaining .Is there any issues you have seen in the past where immigration officers denied the entry in US since visa validity is very less .

      Thanks

You can enter even on the last day of your Visa, your new I-94 date will depend on petition type and time remaining in the 5 or 7 year limit as mentioned above.

This refers to the new I-94.
