  • Green Card and Expired H1 (or) Spouse L2

    Hi All,

My current H1B visa in US is valid only up to April 2012. My green card processing has just been initiated and it may take at least 3-4 months to file my GC. With the processing of my green card, I am pretty sure that I would have to leave the country before my green card is filed. If all goes well and once the first stage of GC is approved, will I be able to come back into US by getting an extension (and visa stamping) of my expired H1 (even though the GC was filed after the H1 expired)?

Also, my spouse, currently works in US too on her own L1 and she still has 4 more years of extension on that L1. There is a discussion with my company that I may be allowed to continue working in US on a L2 (with EAD). My question here is, if my H1 expires and if I start working on a L2 and then the first stage of my GC is approved, could I still use my H1 for future extensions (even though I have a L2 visa)?

With the options I have above, is it better for me to continue to work in US on H1 or to move over to my spouse’s L2?

    Thanks for your time.

    Regards
    Ali.
