  • L1 getting expired

    I am on L1B visa in US from last 5 years. I would reach my max 5 yr cap in november. Now I have few questions:

    1. I understand if i apply for h1 now ,and if it gets approved in oct i would get h1b for 1 year only. My question is does my stay of l1b have any negative impact on my chances of getting h1b for 1 year. Is there any such thing that if we are requesting h1b visa for just 1 year then chances of rejection are more?

    2. my spouse has h1b visa. can i move to h4 visa if required and stay in US as long as her h1b is valid . or is it that i can not stay even as h4 dependent as i have maxed out my 5 year L1 limit.

    No such thing. It does not matter.

    You can certainly stay in H4 status as long as your spouse maintains H1 status. However, you cannot work in H4 status and staying in H4 status cannot be used to reset the H1 limit.
