L1B Extension and Tax returns

Hi,

I am in US in L1B visa for last 2 years and my I94 will be getting expired on June 2012.

Still my company is paying me only per-diem here and I am not paying any tax here in US for last 2 years, but paying tax back in india since I am getting my salary there. When I asked my HR about this they said since I am getting only per-diem here no need to pay the tax here in US.

So my question is , if I need to go for L1B extension whether they will be asking for any US tax return docuemnts or not.

You better consult a CPA first.

This is illegal. On L1 you are employed by the US employer. You must get paid the salary as per labor laws. You can complain to DOL for unpaid wages or sue the company. Consult a lawyer experienced in immigration matters.
