  • L1-A years count as part of H1-B's 6 years?

    Hi All,

I've been here in the US for 4 years on an L1-A visa, it was renewed on a trip to Toronto last dec so I have until dec 2013 on that visa and I-94.

I have an oportunity to have a new position sponsor me on a H1-B visa and towards green card, but I am unsure if the H1-B would only be valid for 2 years as I've 'used up' 4 years of my stay on the L1-A?

I belive that L1-A is dual intent so am I better sticking with my L1 visa and having my new job start the green card application from there?

    Thanks in advance.

L1 stay counts towards the 6 year limit.

H and L both are dual intent. The advantage with L1A is that your L1 employer can process your GC in EB1.

    Thanks in advance.
    See above.
This is my opinion and not legal advice.

      ok thanks

      Thanks for the info,

Sounds like I would be better off staying on the L1-A while my (same) employer starts the EB-1 & GC... whatever they are

      I'll go read some more.
