  • L1A cancelation and apply for L2

    I had taken L1A visa for myself and L2 for my wife and children last year. However my wife who was working in another Indian company in India that time did not travel to the US with me since she had just got a promotion. I went to the US alone and realized that my company is not giving me what they had promised...be it salary or work satisfaction. They blame is on the current economy here in the US.

    In the meantime my wife's company has approved her to apply for L1A visa for herself to move to the US and take care of their US operations. I wish to leave my company and apply for L2 visa along with my children and move to the US all together.

    Please let me know if this is possible and if it will affect green card in anyways. Also please advise if we need to inform UCICS of cancelling my present L1.

    Yes, you guys can do this.

    Yes, it will affect your GC processing and it depends on your current stage in GC, so you need to write details about your GC.

    And if you guys plan to come on L1A, you will be eligible for GC in EB1 and you will get your GC in less than an year if all goes well, so you need not to worry about your current GC process.

    You need not to inform USCIS to cancel your current L1, they will cancel your L1 visa when you go for L2 visa stamping. Sometimes they may not cancel also. Ofcourse if you come on L2 visa you cannot use your L1 status.
