  • L1 Individual RFE - Peimium Processing - 15 days over

    My company filed RFE response to USCIS and the latter received it on Feb 1st 10:00 am by UPS. My case was filed under premium processing earlier. The status still shows as RFE Sent on that earlier date(Jan 4th). Please let me know your thoughts. When can I expect a decision for my case as the 15 calendar days is over.

    The clock starts when USCIS takes possession of the response. Physical courier delivery date or fax date does not matter. Your employer should follow this up with USCIS. If decision is not made within 15 days, USCIS will refund the PP fee.

      Thanks for the info

      The date I mentioned was courier receive date by USCIS. Any idea on what time frame do they take the response from the date received. Also I want to confirm if Premium processing is applicable for RFE as well. Approx when can I expect a decision?

        There can be about a weeks delay between physical delivery and clock start date. So I would say there should be a decision in about a week.

          Thanks a lot, my employer (one of the worlds largest software company), says that RFE need not be treated as premium, and USCIS can take time to decide, 15 days may not be applicable for rfe. I have asked this in many forums and extensively researched on the internet. It would great if a senior member can clarify. It would also help other folks who might face a similiar situation..

            When USCIS sends the RFE, they stop the clock. When they receive the RFE response they start it back and they are still responsible for making in a decision within 15 days or refund the fee. It is just that their clock start somewhat (a week or two) later than the actual physical delivery.

              Still the status is the same. My employer says its quite commonthese days that RFEs are taking longer time than the usual 15 calendar days limit. Please share your thoughts..

                my company Applying L1 individual premium processing for me.i have submitted all the documents.they told you will get response in 6 weeks..if you don't mind could you please tell me what is RFE???

                  If they apply in premium processing, then you should get the result within 15 days. RFE means request for evidence. Meaning, USCIS will request you to provide more documents before they can take a decision on your petition.

                      L1A Individual RFE 2015 approved

                      My fresh Individual L1A application(Big Indian outsourcer company) was upgraded to premium processing and notified by USCIS that they received this upgrade request on 13th Jan 2015. RFE was decided on this application on 20th January, but the USCIS status site reflected the RFE information only on 27th Jan (a whole week to update USCIS site!) . My RFE response was received by USCIS on 25th Feb 2015, and they took an approval decision on the request on 5th March 2015(7 working days). This time, the USCIS status site was updated regarding this decision on 6th March 2015.
