  • L2 Visa --EAD in process- Need to travel to India

    Hi,

I came to USA on Dec 17th on L2 Visa which will expire on June 2013 , and applied for my EAD on Dec 26th 2011 through USICS online .
I sent the supporting documents on Dec 29th 2011 through UPS. Then I received ASC on Dec 29th itself of Jan 18th 2012.
I have done my biometrics and waiting for my EAD.

    The Question is:
    1. Can I travel to India mean time before my EAD comes ... I am planning to visit india on march 14th 2012 and want to return on April 16th 2012?

    2. Does my I 94 changes if I visit India ?

    3. Do I need to re-apply for New EAD if I visit india before I get my EAD ?

    Please reply ASAP.

    Thanks,

    1. It should not be an issue.
    2. I-94 will be taken by the airlines while departing the US. You have to ensure that they take it back. When you re-enter US a new I-94 will be issued.
    3. You do not need to re-apply the EAD.

This is my personal opinion, not to be taken as legal advice.

      >>> You should not leave the country when the EAD is under process. EAD will get declined if you travel outside U.S.

      2. Does my I 94 changes if I visit India ?
      >>> Yes. You will get a new I-94 upon your return and that will have a different I-94 number. You should surrender all your current I-94s when you leave the country.

      3. Do I need to re-apply for New EAD if I visit india before I get my EAD ?
      >>> Yes. There are lot of similar posts on this topic. Search and read them.
