  • I-94 question

    Hi,

I have recently returned to US after visiting canada for few days.

My L1B visa is expiring in Aug 2012 and maxing out in Oct 2012.

The immigration officer had put a date of Aug 2014 on the I-94 and Aug 2012 on the rubber stamp on the passport page.

The confusion is the I-94 date is beyond the visa expiry and max-out dates.

I was planning to apply for a recapture until Oct 2012 and apply for extension of my spouse's L2.

Now can I take it granted that my I-94 is valid until Aug 2014 and not apply for recapture ?
and also can I take this I-94 as base for my spouse's L2 and EAD extension ?

    Can anyone please advice ?

    >>> Well, it is the individuals responsibility to follow the immigration laws. Irrespective of the I-94 validity, if you overstay beyond your 5 year limit on L1B, it can cause issues with your future petitions, visa interviews or GC process.

and also can I take this I-94 as base for my spouse's L2 and EAD extension ?
    >>> L2 or L2 EAD cannot be extended based on your I-94. Your will need an extended L1 petition to extend the L2/EAD.
Not a legal advice. Use of this information is strictly at your own risk.
