  • L1B to H1 while GC in process

    Hi All,

Below is my current situation, any advice on it is highly appreciated.

I m working in US on L1 B for last 18 months and my current employer is planning to start GC process this month (EB3). In the meanwhile I got an offer from another company and they are willing to process H1 (so I can start working with them from october). Can the GC process started by my current employer be continued by future employer once I change to new company? or should the entire process start again? Are there any specifics which I should know before the transfer.

    Thanks,
    Veera.

The entire process need to be started from scratch by the new employer. However, if your I-140 gets approved with the current employer and if you have a copy fo your I-140, then you can port the priority date when it is time to file I-485 with the new employer.
