  • L1 Visa Extension

    My L-1 Visa is going to expire on Apr - 15. But my I-94 is valid till May-15. I submitted the required documents to my company for L1 extension. My company is yet to assign someone to look at my documents and then go for extension. My questions are

    1) Whether company has to file my extn before Apr-15 & get the acknowledgement from USCIS also before Apr-15 inorder for me to work legally in US. Is it mandatory to do it before Apr-15 or it can be done between Apr-15 & May 15 ?

    2) Incase if my company is sending my file for extension on April 14 & If I get an acknowledgement only on May 1st, whether I can work between April 15 & May 1st ?

    3) Incase if my company is coming back to me on April 15 & telling that they are not going to apply, whether I can leave any day between Aprl 15 - May -15 ? Will it not create any problem like overstay If I go for a new application next year ?

    Please let me know asap.

    >>> You status will expire on May 15th. So the documents for extending your status should USCIS before May 15th and you should have a receipt notice with the receipt date before May 15th.

    >>> Yes.

    >>> You can leave anytime before May 15th. Any time spend in U.S after May 15th without an extension being filed will may your stay beyond May 15th illegal.
