As mentioned in my previous posts, I am on L1-B and it will expire in Jul 2013. I wanted to convert to L1-A now. My employer told me that they will support me but they are worried about the US company size (our US company is the mother company, which has about 8 people, the oversea company has about 80 people). The lawyer working for our company told me that applying for L1-A is technically doable but it is risky because of the company size. They suggested to convert to H1B and file GC for my wife (I will fall to EB3 and my wife will go to EB2). But I have heard that company size does not matter as long as the company is eligible. I know my employer really wanted to keep me, I am wondering if the company and the lawyer had some communication behind and are trying to fool me... Seniors, does company size matter so much that I shouldn't even try?
Secondly, can I file for L1-B to L1-A AND H1B on the same time?
