  • L1 extension to H1

    Hi
    I working for Company A with L1 B visa. As my visa & I94 got expired by August 2011 my employer applied for L1 B extension. When the case was in process Company B applied H1(COS) for me last November. Now my L1 B is approved till September 2013. In his situation i have few questions.

    1.Do my L1 status will get change immediately if my H1 gets approved?
    2.Or will my L1 Status change only if i started working with H1 employer?

    If your L1 to H1 is approved as COS, your status will change to H1 from the start date on the H1 approval notice. So, from that date you must stop working for L1 employer and must start working for the H1 employer. But, if your H1 is approved for consular processing, then your status won't change to H1, until you leave US and come back with H1 stamped. In this case, you can continue to work for the L1 employer until the I94 expiry.

      Search and read about the last action rule. Whichever petition becomes effective last will become your status and you should be working for that employer.
