    Hi,
    My husband is on l1 visa and his extension was approved.
    Do I have to apply for my extension ie l2 extension separately
    And can I travel to India with his extension copy

    If your I94 is expiring within 6 months, you MUST apply L2 extension to stay in US. You are allowed to stay only until your I94 expiry date. L1 extension will not extend L2, it need to be filed separately.

      Do you currently have a valid I-94? When does your I-94 expire? Why didn't you file the L2 extension along with your spouse's L1 extension?

        My I 94 is expiring next year ie 2013 June becoz I alone visited India 6months back so got my i94 upto 2013.
        And my spouse company said there is no need of applying my extension ie l2

        Can I travel to india with his extension docs

          L2 extension

          Once you are outside US the I-94 loses its validity and as it is you should surrender the I-94 while leaving US. For entering the US again one should see the Visa validity in passport. When is L2 visa in your passport expiring?

            If your latest I-94 is valid in the future, you don't need to file any extension until it expires. It only needs to be filed before I-94 expires.

              Since your I-94 is valid for a longer time, there was no need to file your L2 extension. When you leave the country, return all the I-94s. When you return back, you will get a new I-94 matching your spouse's L1 petition expiry date (You will have to carry your spouse's L1 approval notice when you re-enter). You will need to file the extension only when your latest I-94 is about to expire. Extension of status can be filed 6 months prior to the I-94 expiry date.

                My I 94 is valid till 2014 hence my extension wasn't filed. But my l2 visa is valid only till 30 June 2012. If I leave the country I will need a valid visa I suppose. My husband i94 expires in June 2012 hence his extension was alone filed and not mine. His extn was approved and we have the 797. Do I have to have my l2 extn before I travel to India.

                  You will need a valid L2 visa in your passport as of the date of your return. If you don't have one, then you should appear at the U.S consulate to get a new l2 visa. Your L2 extension is not required to get the L2 visa stamped. You need your husband's valid extened L1 petition to get your L2 visa stamped. When you return back, you will get a new I-94 based on your husband's extened L1 petition expiry date. Make sure you return all the I-94s when you leave @ the airport.

                    I have another query I am actually from Hyderabad India and there is a US consulate in Hyderabad
                    Bt can I get my l2 visa stamped at same or do I have to go chennai India

                    I hav 2 year old son who is US born is it necessary to take him along with me for stamping with his PIO card
