  • Clarification about L1 Visa petition

My company has decided to file L1 visa petition for me to transfer to parent company in US.Pertaining to this I seek few clarifications.

1.What is the rejection rate of L1 petitions in India and which visa type among L1 blanket and individual has more probability for approval.

2.If I travel to parent company in US with business visa(type 1) while my L1 petition is in process, will it have any impact on my L1 visa ?

3.What is the usual time duration for L1 blanket and individual visa processing.

4.After getting L1 visa can I apply for H1B if company sponsers?

5.Should any proofs to justify my return back to India be provided during L1 visa interview in consulate.

6.Any restrictions imposed about number of times that I can travel back to India and US in L1 visa?

Thank you shervin143 for your response.I have a quick question about L1 blanket v/s L1 individual.Apart from reduce in processing time is there any advantage of Blanket L1 visa over L1 individual?
Could you please provide more details about how L1 individual has more probability of approval for L1 blanket.I need this as company is planning to process for L1 blanket visa.

        Check

Suggetion is your company attorney's/HR knows the best way to apply for L1. again this is not something you can demand for I guess. There are no specific reasons for rejection/approval. Each case is different depends on individual specialized knowledge etc. So be confident and let your company decide the best and hope for the best.

Just search the forum for L1 blanket rejections. The rate is higher compared to L1 individual. In your case, you can try for L1B and if it gets rejected, then apply for L1 individual or H1B.

            Thanks all for your response...

Also I came to know that if my L1 individual or blanket visa gets rejected then there are chances that existing B1 visa also will be revoked and won't be able to go to US for business or tourist purpose in future. Is that true? Can anyone please clarify this and details regarding this is much appreciated.

              Clarification about L1 Visa petition

There is no such hard and fast rule that a rejection of L1 will also result in a cancellation of an existing B1/B2. Its a case by case decision by the VO. The cases in which existing B1/B2 might have got cancelled are those where the applicant would not have followed the B1/B2 usage guidelines in letter and principle. For example, someone who has traveled multiple times and stayed extensively (more than few months each time) on B1/B2 prior to applying H1/L1 then VO might feel that the individual is actually working on B1/B2 which they should not be and revoke the existing visa B1 and also reject the L1/h1 visa. Again, its case to case basis. This is my opinion, do seek expert opinion too.
