I was working on L1B visa which was expiring in October 2011 and an extension was filed by my company in June 2011. In September, I got an RFE and we responded to the same in November. However, in December I had to travel to India while my L1 was still under extension, and I returned to the US in January 2012 with my spouse (he is on H1) on an H4 visa since I had taken a 6 months leave from my company to take care of my baby.
As per the USCIS site, my L1 case is still in the RFE response review stage.
My leave is getting over and I'm supposed to return to work next month.
Q1. Is it usual for the RFE response to take this long (the extension has been with USCIS for 11 months), or has my L1 become invalid since I exited the country while extension was in process? How can I find this out?
Q2. In this situation, if I get my L1 approved within the next month, would my status be automatically changed from H4 to L1 so that I can start work? Or should I exit the country and come back on a stamped L1?
