  • Replacement of I94 after passport renewal

    Hi

I am in L1B visa (valid thru Jun 2014) and I have my I-94 date till June 2014. My wife joined me in L2 in March 2012. Her passport is expiring in Oct 2012. So she got I-94 till OCT2012 only. She has renewed her passport now in the US for a 10yr period .
I would like to know how to get her I-94 extended till Jun 2014 ( Her visa expiry).
Some people say I need to contact CBP office and it can be rectified. Some others say I need submit a I-102 form and it may take 2 to 5 motnhs ( I am not sure to which office) , While others say she needs to go out of the country and return back and get a new I-94.
It will difficult for her to go out of country and come back.
I would like know valuable suggestions on this and what should be the correct way to get it rectifed quickly.

    Thanks
    Karthik

First she should try visiting nearby CBP deferred inspection post at a nearby airport. That may or may not work.

If that does not work she has two options,
    1. File I-539 to extend status based on your I-94. Approval notice will arrive with a new I-94.
    2. Leave the US and return to obtain a new I-94.

One of these options must be exercised before the current I-94 expires.
This is my opinion and not legal advice.
