  • L-1 with a nonprofit?

    My friend owns a nonprofit organizatio in Europe; the organization is extremely successfull with over 30.000 members and growing. Last year my friend was presented the idea of opening a branch of his nonprofit here in the U.S. . He loved the idea and started the process: investing close to $70.000 in location, equipment, fees, etc. he has been trying to find a lawyer that could assist him with his petition. Unfortunately we have been unable to find someone who has a clear idea of what needs to be done.


    We keep being told that it is too difficult to obtain an L-1 with a nonprofit organization, but nobody can actually explain why.

    With the premise made that the organization meets basic crateria ...and more; that any type of documentation and proof of operation can be provided without difficulty...


    ... my question would be, why every lawyer we consulted tells us that it would be too difficult to obtain an L-1 with nonprofit? but when I read the general law concerning L-1 I see the nonprofit as being included in the group of organization types that meet the criteria under which and L-1 can be obtained... (???)

    If there truly are differences between ontaining L-1 with nonprofit vesus obtaining it with a for profit, what are those differences and difficulties so that we can possibly overcome said difficulties?

    Please answer as you have an opportunity, we are in a really difficult situation since after making such a big investment it seems as if it might all going to be lost.
