EAD Extension for spouse while H1 being filed by another employer

Hi,

I am currently on L1B visa which is valid till July 2013. My spouse has her EAD(ON L2 Visa) which is due for renewal in october 2012. Another employer has submitted an H1B petition for me which, on approval, will be valid from Oct 2012.

Can my wife apply for EAD extension in parallel as it takes 4 to 6 months for a renewal of EAD on L2 visa? I would want to continue on L1B if by any chance my H1 gets denied.

Yes. But if your H1B gets approved as a COS from L1B, then you will bein H1B status as of Oct 1st and your wife cannot continue tio work on L2 EAD. Have you filed the H4 for your pouse along with your H1B? If not, she will go out of status on L2 when your status chnages to H1B.
