Got L1 extension but wife in India

Hi,

1) I got my L1 extension approved, also my company applied for L2 extension along with my L1 extension, at that point of time my wife was with me in US. While the extension was in processing , she went to India for an unavoidable circumstance. Now, when they approved my L1 extension, they sent the approval for L2 extension as well. My question is, Can I use that L2 extension document and get it stamped in India for her L2 Visa?


2) My company also applied for L to H conversion for me this year, in this scenario, Can I apply L2 for my wife, or do i need to wait for H1 approval and apply H4 only?

She needs to use your extended L1 petition to apply for her L2 Visa. L2 extension is meaningless once she leaves the US. Save it in your files.

If she is traveling before Oct 1, she will need L2 Visa and then immediately file change of status to H4 after she arrives in the US. If she is traveling after Oct 1, she will need to obtain H4 Visa based on the H1 petition.
