  • Extension of i 94 on L1

    Request you advise on the following

    I am on L1 visa and my i 94 is expiring in Nov '12. My visa stamp is till Apr 2013 . The i 94 was shorter due to validity of passoport.

    I have already mailed my passport for renewal . My company has advised following options To extend my stay beyond Nov. '12

    - Fly outisde the country and come back with renewed passport. I shall get a new i 94 .
    - Apply for i 94 extension thorugh USCIS route.

    I have following questions :

    If I apply for extension before , I extend my i 94 upto April by flying outside the country. Would I be able to stay in US upto new i 94 ( till Apr'l) , even if I get denial on extension from USCIS .
    OR would they consider the i94 date provided with the appliction ( i.e. Nov '12).

    If I apply for USCIS and get an approval and stay upto plan and leave the country before new i 94 expires. Can I go and get visa stamped from India , even if I have no immidiate plans to come back. I mean would they ask me for any plans to go back to US again .

    You should not do both. Either travel or file extension. Considering the wave of L1 extension denials, it is better that you just travel and return. If you have more time left from your total 5 years of L1B, you can even get an I-94 beyond April 13.

    That's confusing. Do you want to stay in the US beyond Nov 12 or not?

    You can remain in the US as long as your I-94 is valid.
    You can travel to US from outside as long as your Visa is valid.
