Need some help with my spouse L2 EAD status.
My L1 visa and I94 expiring on 31/Oct/2012.
My spouse is on L2 Visa and I-94 valid till 31/Oct/2012 and is working on EAD which is valid till Sep 2012.
My L1 extension got RFE and I am planning to go to Canada for stamping.
I filed my spouse L2 and EAD extension along with my L1B extension and the L2 EAD status went into RFE asking for my renewed I-797 and I129.(RFE response due date Aug19-2012)
1. If both of us go for Canada for stamping and come back can my spouse continue working on the current EAD till we get the new EAD based on the new L2 and I-94?
2. Will the current EAD become invalid since we will be getting new L2 stamped and I-94?
3. Once we get new L2, do we need to withdraw the current L2 EAD application which is in RFE status? If so how to withdraw the L2 EAD?
4. Once we get new L2, do we need to apply for a new L2 EAD application based on new L2 and I-94?
5. Once we get new L2 can I respond to L2 EAD RFE and get it re initiated? The L2 EAD application is based on current L2 and I94.
I do not want to jeopardize my spouse working status, please suggest me which is the best option.
