    My wife has L2 valid till 18th Nov'12, now can the company file L1B for her... as per the L1 eligibility... she has worked with the same company for 1 yr in the past 3 yrs (In India)

    Is this possible? If yes, then please let me know the procedure and is it required to leave the country to get the L1B stamped?

    Yes. L1 petition can be filed with change of status. After approval she can start working without leaving the US.

      Can the company file the L1 Petition right now or does the company needs to hire the resource first and then process the petition?

            She does not have to be currently working at the Foreign office if the 1 year during past 3 requirement is satisfied.
