L2 to L1B (Urgent)

My wife has L2 valid till 18th Nov'12, currently she is not employed, now a company is ready to file L1B for her... as per the L1 eligibility... she has worked with the same company for 1 yr in the past 3 yrs (when she was in India)

Question 1: Can the company file L1 Petition right now or does the company needs to hire the person first and then file the L1 Petition?

Question 2: L1 Petition can be filed anytime during the year, correct?

>>> L1 is for intra company transfer. She has to be working for the employer so that they can tranfer her to the overseas entity of the same company. A latest offer letter is enough to file the L1 petition.

Question 2: L1 Petition can be filed anytime during the year, correct?
