  • Spouse's I-94 extension - New visa

I received my L1-A approval (I-94 extension) recently.

My family is in India right now, can I bring them to US with my new I-94 validity without me traveling to India? For this question, I found the answer in immihelp. And I thank the forum members for the quick support.

When my family (wife and 2 kids) was in the US last time, they had filed for the extension of I-94 (based on my visa which was valid till Jan 2011 at the time of filing my family's extension) on May 12th 2010, whilst their visa was expiring on 22nd May 2010 .
Four months after filing the extension (September 2010), my family returned to India even before any decision was made by USCIS. The status remains in “INITIAL REVIEW” even today. Is this going to be a problem when my family will apply for L2 visa now? My I-94 is valid till 2014.

Their EOS will get declined if they leave the country. They can return back using your latest L1A approval notice on a valid L2 visa (If they don't have a valid L2 visa in the passport, they will need to get it stamped). They will get a new I-94 at the POE matching your petition expiry date. Your I-94 will ot be considered.
