  • I-94 Receipt notice from USCIS.

    Hi All,

    My company has filed the I-94 extension for my dependents (they are on L2 visa) few days back but still I have not received the receipt notice from USCIS and their I-94 will get expire in another 20 days.

    Please suggest,
    Can they stay in US after their I-94 expiry, if I won't get the USCIS receipt till that time based on the filed extension?

    It will take time to receive the receipt notice. Filing it at the last minute was your mistake. USCIS gives you 6 months time to file the extension. They can stay past the I-94 expiry date as the extension has already been filed. The risk is, if USCIS rejects the documents after their I-94 expiry date for a missing signature, incorrect amount in the check etc (for any reason) without issuing a receipt notice or if extension gets denied later, their stay in the country past their current I-94 expiry date will be treated as illegal stay.
