  • Moving from L1 to H1. help required

    I am currently on L1 and I have an approved H1 from the same company from Oct 1, 2012. I have other employers ready to transfer the H1 in their name from Oct 1. My company has a 2 week notice period so if I have to start on the new company from Oct 1 I have to resign by mid September which means I will be still in L1. If the current employer decides to relieve me the same day should I go back to India? is there a grace period? Can they withdraw the H1?
    What should be my ideal plan of action?

    >>> Yes. Otherwise you will be out of status on L1 from Mid Sept to Oct 1st.

    >>> No.

    Can they withdraw the H1?
    >>> They certainly can. But that will have no impact on your transfer.

    What should be my ideal plan of action?
    >>> Here is one option. If the transfer is successful, then resign the current employer on Oct 1st rather than Sept 15th. If the current employer asks you to leave immediately, then you have the option to join the new employer immediately. If not, serve 15 days notice period and join the new employer on Oct 15th.

      I have a similar situation and my attorney told me I have 60 days to move from L1 to H1. ie- I should find a job and move on or before 1st Dec.

        This information is incorrect. Do consult a good immigration attorney on your own. The attorney employed by your employer will always talk in favor of the employer. Here is the detail reply to this same note.
