Query on L1 visa extension and applying for L2 Now

My L1 Visa and I-94 expired on Dec 2nd 2008 and stayed till Dec 27th . I have applied for extension before the expiry date. When i am staying in India I got RFE and we have withdrawn extension . Now I am going for L2 visa stamping , will it be a problem .Is my stay from Dec 2nd 2008 to Dec 27th 2008 is condsidered as illegal.

Please respond as soon as possible since my PA date could be sometime next week.

>>> Well, no one can predict that. But if asked, you can mentioned that the extension was filed prior to the I-94 expiry date and you were staying on the pending extension.
