  • Shift to another group company

Hello, I am on L1A visa since last one year. My company is moving/shifting me to one of their group companies which has another name. However ownership is the same. Is this a problem ?? Can I apply for a green card in another company's name even though both the companies are part of the same group & there is paper work for that.

G.C is for future employment. So filing GC is not an issue.
Not a legal advice. Use of this information is strictly at your own risk.

So does it mean that even if I have L1A from company "A", I can apply for GC under company "B" by shifting my job ? Is L1A not a non-transferable visa ?

When the parent entity is the same I dont think so it matters. If A and B have different parent entities then obviously one cannot transfer L1 from A to B. Check your 797 it would list all the group companies to which the L1 would be applicable, what that means is that you are allowed to work for any of those group companies. Further, do consult with your company lawyer too. This is my opinion.
