  • L1 to L2 conversion while working on L1

    Hi,

Can someone pls help me out? My husband & I are both on L1 B visas working for our respective employers in the US.
Now, I'd like to get an L2 as a dependent of my husband and work for other companies here using EAD.
    1. How long can I keep working on current L1 once I apply for L2?
    2. Do I have leave and enter the US again to get my L2 stamped for me to legally work on L2/EAD?
    3. Can i apply for EAD alongwith L2?
    4. Can i continue working with my L1B employer once my L2 has been approved.
    5. If filing for EAD with L2, would both come together or is there a gap between L2 and EAD and if I can continue to work at that time?

    Thanks in advance,
    Katey

    1. How long can I keep working on current L1 once I apply for L2?
    >>> You can work till the L2 gets approved or quit after receiving the receipt notice. If L2 is rejected, you can (and you should) continue working in L1 as you will remain to be in L1 status.

    2. Do I have leave and enter the US again to get my L2 stamped for me to legally work on L2/EAD?
    >>> No. The COS from L1 to L2 if approved will come with a new I-94 which will allow you to work. You will need to get the L2 stamped only if you leave U.S and want to re-enter in L2 status.

    3. Can i apply for EAD along with L2?
    >>> Yes.

    4. Can i continue working with my L1B employer once my L2 has been approved.
    >>> Yes (In L2 status and only after receiving the EAD).

    5. If filing for EAD with L2, would both come together or is there a gap between L2 and EAD
    >>> You will get them separately.

and if I can continue to work at that time?
    >>> Once L2 gets approved, you cannot work until you get the EAD approved.
Not a legal advice. Use of this information is strictly at your own risk.

Dependent having separate visa - green card filing

Hi, I am in US in L1 A visa. I plan to apply for Green card in 10 months. My spouse is an employee in the same company and is coming to US on a separate independent L1 B visa.

I wanted to know can my dependents (although she has independent visa)apply for green card along with me when I apply for my green card ? Officially they are not my dependent as my spouse has a separate visa.

Does my dependent needs to be converted to L2 from independent L1 B first to be eligible for filing green card application with me ? In that case does she have to quit her company as she have to wait for her EAD with L2 or that is not required ?
