    Hi

    I have an L2 which expires in the next 40 days, we have just filed for an extension for L1 and L2. I(only L2) have to travel to India due to some unavoidable circumstances nearly around the time my visa gets over. If the Visa gets approved, can I get it stamped and return back to US, even though the L1 petitioner's visa is not stamped, it is only approved. L1 petitioner cannot travel to India to get his visa stamped. Is there a chance that the extension of L2 can be denied because the L2 petitioner left to India? If so what can be done next?

    Your spouse's valid L1 visa is not required for you to get your L2 stamped. L1 petition is what is required to get your L2 stamped. If you are leaving before your current I-94 expiry date, then you don't have to worry about your L2 extension. That is of no use if you are anyhow leaving before the current I-94 expiry date. If it gets approved before you leave, then surrender the I-94 that come with the approval along with the other I-94s when you leave the country. In order to get the L2 visa stamped and return back, L2 approval notice is not required. You will need your spouse's L1 approval notice for both.
