  • L1 B VISA Expiring in DEC

    Hello,

    My L1 B Visa is getting expired on 12th DEC 2012, and I am in urgent need for travelling back to INDIA in the month of SEPT to Mid OCT,2012.

    Will there be any issues at the port of entry since only few months left on my VISA?

    Also, till what time I can apply for L1 B VISA extension before expiry of current VISA? Please advice soon

    What sort of problem are you anticipating? If you enter US before your visa expiry in most likelihood they will allow you at the POE without any problem.

    How long would they authorize you to stay in US is a different matter. Your Stay in US is determined by your I-94.

    So , when you re-enter US before 12-Dec-2012 they might give you I-94 for 3 Years, or for 1 Year or till 12-Dec-2012, or till any other duration, no one can predict that. Its at the discretion of the VO at the POE.

    One can file extension upto 6 Months before I-94 expiry.

      I had the same case and I travelled to US when I had my L1B blanket visa to expire in 3 months. The duration of I-94 depends on several factors but if you have L1B blanket and you are in your first 3 years of VIsa they might issue you a I-94 for longer duration. They might ask you how long is the project and if you say 1 year or so they ight give you extended I-94 for 1-2 years. But if you get extedned I-94 your company can not apply for your Visa extension until your I-94 is expiring (6 months or less). so you got plan accordingly, if you are planning to visit indian in few months after visa gets expired and your company is ready to apply for your visa extension, you should look for shorter period I-94. Probably the date when your visa is expiring by telling in VO that you are here for 3-4 months so that your company can appply for visa extension.
