  • Unused and expired H1B. Planning for L1 A

    Hi,
    I had H1 B stamped, but due to personal reasons I did not travel to US and did not use the H1 B visa. Now that got expired. Now my company is planning for L1 A. Will there be any issue for me. On another note, before H1B stamping in india, I was in US on L1B for 3 years. Pls let me know.

    If you are eligible for L1A you should not have any issues. In Any case, if your L1A is rejected and if you are already cap counted in last 6 Years you can transfer the H1, go for h1 stamping and use the H1 to travel too. this is my opinion not legal advice.
