Reapplying for L1 - B Blanket with a past "petition not clearly approvable - 221(g)"

  • Reapplying for L1 - B Blanket with a past "petition not clearly approvable - 221(g)"

    Dear forum members,
    I had a 221(g) petition not clearly approvable denial on my L1 B Blanket petition in feb2012.
    The VO was quizzing me on financials and balancesheet numbers of my client which i could not answer satisfactorily.
    He finally told me that my specialised or in depth understanding of my customer could not be evidenced and hence he can not approve my petition.
    ALthough he encouraged me to reapply and also said that i have a fair chance of geting the visa(ironical and amusing, but this is what he said)
    Now i am again applying for the same blanket visa(for the same client). Assuming i prepare well this time and am able to handle the questions, is there any policy issue which might not at all allow me to be considered for visa as i was not granted one in the same category in the past.
    Please advise.

    Lately L1 especially Blanket petitions have been scrutinized more often and the slight doubt about ones specialized skill set or client strongly increases the risk of rejection. In most likelihood they will reject again as they might be wondering what have you developed or learnt about the client in 4 Months which you didnt know earlier and how come the same thing cannot be imparted to someone in US in these 4 Months. In my opinion, you would have better chances if you opt for L1 Individual or H1. Due to stricter verifications nowadays, many of the L1s which were granted 3-4 Years back are not being extended. This is my opinion not legal opinion.

      have already applied and my interview date is 6th Sep,would you rcommond that i witdraw as you feel there is absolutely no possiblity of this going through or you feel there is some chance(bleak and slight it might be)
      In case this gets rejected again will it have any negative impact on my profile for future applications.I actually do not have strong training records etc required for individual petition and H1 is over for this year.
      Any other question you feel i might have to face.Any cases in your knowledge where 2nd tial has yielded to success.

          Hi, same case happened with me. I applied for an L1B in May'2011, but got refused (a 221(g) petition not clearly approvable denial on my L1 B Blanket petition). I reapplied in June'2012 with same company, same client, same team and this time i got it

          1. They will not ask why your visa got rejected last time provided you will have to make some changes in your specialized skills but should somehow relate to the old one.
          2. If they ask, you can reply them that you are not sure (as they do not provide you the reson for rejecting) and was advised to contact your HR to reapply (with a smile on your face)

            Can't tell you how relieved i am to hear of your case .Assuming that you again filed blanket petition when you reapplied.
            Were you asked about your last denial?
            Unfortunately for me the VO did not ask even a single question abt my company tool,framework methodology etc, the whole interview was on client balance sheet and financial analysis.
            Hoping for a miracle this time.

              Hey, yes, both times applied for L1B blanket (same company, same client, infact same work, same team but did some changes on the proprierity tool and my specialization on it). The VO did not ask anything about last denial, and they normally they do not ask because they take your application as a fresh application. If they ask, you can simply say " I am not sure officer however i was adviced to contact my HR for reapplying with a smile on your face (say only reapplying and not other visa category coz VO might say that why are you not applying for other visa category)". You should certainly be aware of your company and the client in terms of their business, balance sheet or whatever it may be. Practice again and again with all possibilities. I hope you get this time
