H4 to L1 conversion in USA

  • H4 to L1 conversion in USA

    My wife works for a company in India for more than 2 years, she took 3 month vacation and came to USA on JUNE 03, 2012. Through H4 VISA

    She was here in USA for past 3 month (on Vacation)

    Now here employer wants to sponsor her L1-Premium VISA to work in USA

    Can she able to convert here status from H4 to L1 directly without going to INDIA.

    What is your best advice?

    1. Applying for change of status (H4 to L1)

    2. Returning back to India and Re-entering to USA in L1 Visa status

    Which will have best 100 % success rate?

    In my opinion a COS from H4 to L1 is better as in that way even if there is RFE or some delay she is still here in US with you during the processing time.

    There is no 100% success rate formula. If your wife is eligible for L1B and the necessary paperwork is in place she should be able to get it.
