I work for a small non-profit and we do one or two L-1 visa requests a year in-house to bring foreign employees over here from our international subsidiaries. We've had very good luck till now, but we've received RFEs for the last three. We currently have two RFEs pending for L-1B requests. I've been looking around and found an interesting blog post (bit.ly/QzEbRA) that talks about the importance of citing case law, the USCIS Adjudicator's Manual, etc. in replying to an RFE. The argument we want to make is that we have specialized ways of advocating, working with clients, and writing reports that take time to learn and that for certain positions within our organization, employees need at least three years of formal and on-the-ground training. Besides citing the specific individual specialized knowledge our employees have, does anyone have any suggestions for ways of citing case law, the Adjudicator's Manual etc. to back up an argument for organizational specialized knowledge?
One possibility that I was looking at is just requesting that based on the evidence we provide and the preponderance of evidence standard, USCIS accept our petitions for these two individuals.
