L1 visa cancellation

  • L1 visa cancellation

    I resigned job from my current employer. I have L1 visa on current employer. I do not want to complete notice period as i m moving another country.

    Can i cancelled my L1 visa without handing over my passport to current employer or i do not cancelled then is there any issue in future.

    You cannot request for L1 Cancellation in passport and neither should you hand over passport to anyone to "cancel" the visa nor does anyone apart from US Consulate has authority to cancel your visas. If you are in US and on L1 you should have proof of being in status. If you are not working for your employer you are out of status and should not be in US on L1 even for 1 day after resignation. The longer you stay after resignation without converting to another status the longer you will be out of status and illegal which can potentially impact your future visa applications. This is my opinion not legal advice.

      I am in india now and my visa will expired in 2013....

      I resinged recently and i am moving to another country....

      My notice period in the company
      is 2 months.......

      Normally my employer take passport and cancelled visa before one week of last day of notice period....

      I do not want wait for 2months...as i want to move AsAp

      my consern is if i move without l1 visa cancllation...is this illegal action....

        There is nothing illegal about having a visa in ones passport. And you will not be in any problem if you move out without cancellation. But you would have to go and read your contractual obligation with the company to determine whether they are entitled to take the visa processing and other costs taken out of your salary or not. This is my opinion not legal advice.
