  • L1 visa extension

    Hi,
I am on L1 visa which is expiring on 01-30-2013, I am on Blanket petition which is valid forever. I have following questions

    1. If I get my visa extension and visit India and come back before 01-30-2012 do I need to go for VISA stamping?
    2. What does https://www.immihelp.com/issuance-of...dity-l1-visas/ post says? Is is applicable in my case.
    3. If I apply for visa extension and its rejected, can I stay till 01-30-2012? If my visa extension is rejected and I go back to India can I enter back in USA before 01-30-2012.

    Thanks

What you mean by Visa extension is extension of status (I-94 extension). That is needed only if you want to stay in the US beyond the current I-94 expiration date. That does not extend your Visa in the passport.

If you plan to leave and return, you will need a Visa in your passport that is valid on the day of travel to US. If Visa is expired on the day of travel, you will need to get one. When you return you will get I-94 according to how much time you have left from the 5 year (L1B) or 7 year(L1A) period and the defaults set by CBP (3 years or 2 years). You should not stay in the US longer than the 5/7 year limit in any case.
This is my opinion and not legal advice.

So if I leave US and return back before 01-30-2013 I dont need to go for stamping. And while I will enter US I will get remaining 2 years on I-94 or I will only get I-94 upto 01-30-2012.
