  • I94 Query on L1-B

    Hello everyone,

I have few questions that are chewing my head, and thought would come here for your help:

I Landed in US on Sep,2012 and got my I94 stamped till Sep2013. However, my L1B Visa is about to expire by Feb 2013, way before my I94.I am planning to travel to India either Nov/Dec2012 for vacation (about week or two) and bring my wife along with me.

    Now the question:

    1. When I arrive to US say in Dec2012 after my vacation, will mine and my wifes I94 get stamped to new date say Dec2013?
    2. In a case, if she has to travel alone in Dec2012 (which obviously means am not going to India at all), will her I94 reflect my current stamped I94 date which is now Sep2013? or will it reflect my Visa expiry?

Kindly clarify me with the above.

    Thanks a lot !!

    1. If you and your wife are traveling together you two would be given the same I-94 date whether its Dec 2013 or not totally depends on the officer at the POE.
    2. In case your wife is travellign alone it cant be predicted what her I-94 would be again ti depends on the officer at the POE. She can show your I-94 and request for an I-94 to match yours but whther it will be granted or not again depends on the officer at the POE.

This is my opinion not legal advice.
